GOSHAWK ON THE WAY TO ENDANGERED LISTING IN WESTERN STATES-
USFWS DETERMINES LISTING PETITION IS VALID

Capping a bitter six year battle, the U.S. Fish and Wildlife
Service, on September 22, 1997, issued a ruling that a petition
filed by the Southwest Center to list the Northern goshawk as
endangered in the western U.S. (excluding Alaska), presented
substantial scientific information indicating that the goshawk
may warrant listing as an endangered species. This is the first
of three hurdles to a final listing, it took six years and two
lawsuits to accomplish.

The Northern goshawks lives in old growth forests throughout the
West, primarily drier ponderosa pine, lodge pole pine, and aspen
forests. It is threatened by logging, overgrazing, and industrial
recreation.

Successful suits to overturn previous denial were filed by the
Southwest Center, the Southern Utah Wilderness Association, ONRC,
Sierra Club, Alliance for the Wild Rockies, Biodiversity
Legal Foundation, the Ecology Center, Save the West, Friends of
the Bow, and others.

GRAZING RIDER ATTEMPTS TO OVERULE GRAZING/LOGGING INJUNCTION-
LETTERS, CALLS NEEDED

Senator Pete Domenici (R, NM) has attached a rider to the Senate
Interior Appropriations bill, barring the Forest Service from
spending any money to comply with the Ninth Circuit Court of
Appeals order to halt illegal grazing in AZ and NM. The Forest
Service itself admits that 715 allotments, 2/3 of the entire SW
grazing program, violate Forest Plan standards and guidelines
designed to protect endangered species, rivers, and riparian forests.

A list of Senate and House subcommittee members is included at the
bottom of this alert. Please call or write them today, demanding
they strip this dangerous rider from the Interior
Appropriations bill.

IBLA UPHOLDS REMOVAL OF CATTLE FROM BLM LAND IN SOUTHEAST UTAH
       
The Interior Land Board of Appeals has upheld a 1993 order banishing
cattle from tributaries of Comb Wash in southeast Utah. The ruling
culminates a three year appeal effort by Joseph Feller (Arizona State
University Law School), National Wildlife Federation, and the
Southern Utah Wilderness Allliance.
       
The order effectively reduced grazing by 10 percent (350 cows) on a
72,000 acre BLM grazing allotment leased by the Ute Mountain
Ute Indian tribe because the BLM refused to analyze the impacts of
grazing on the canyon ecosystem.
